Welcome to Diotrix. By downloading, accessing, or using the Diotrix mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Diotrix. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the App after any changes indicates your acceptance of the new Terms.

2. Description of Service

Diotrix is an AI-powered image generation application that allows users to create images using Google's Gemini Imagen technology. The App provides:

• AI image generation using text prompts
• Multiple artistic style presets
• Customizable image generation parameters
• Local image gallery storage
• Free trial credits and subscription options

3. User Accounts and API Keys

3.1 Trial Credits

New users receive 5 free trial credits to test the service. Trial credits are subject to limitations on available styles, guidance levels, and resolution options.

3.2 API Keys

Users can provide their own Google Gemini API key for unlimited image generation. You are responsible for:

• Obtaining and maintaining your API key
• All costs associated with API usage
• Complying with Google's API Terms of Service
• Keeping your API key secure and confidential

3.3 Subscription

Diotrix Pro subscription unlocks all features, styles, and generation options. Subscriptions are managed through the Apple App Store or Google Play Store and are subject to their respective terms and conditions.

4. User Responsibilities and Conduct

When using Diotrix, you agree to:

• Use the App only for lawful purposes
• Not generate images that are illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Not attempt to generate images depicting real individuals without permission
• Not use the App to infringe upon intellectual property rights of others
• Not attempt to reverse engineer, decompile, or hack the App
• Not use automated systems or bots to access the App
• Comply with all applicable laws and regulations

5. Content Ownership and Licensing

5.1 Generated Images

You retain ownership of the images you generate using Diotrix, subject to the following conditions:

• Images are generated using AI and may not be unique
• Similar or identical images may be generated by other users
• You are responsible for ensuring your use of generated images does not infringe third-party rights

5.2 App Content

All content within the App, including but not limited to text, graphics, logos, icons, and software, is the property of Diotrix and is protected by copyright and other intellectual property laws.

6. Subscription Terms

6.1 Billing

Subscriptions are billed through the Apple App Store or Google Play Store. Billing is handled by Apple or Google, and you are subject to their payment terms.

6.2 Renewals

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your App Store account settings.

6.3 Refunds

Refunds are handled by Apple or Google according to their refund policies. Diotrix does not process refunds directly.

7. AI-Generated Content Policy

The App uses Google's Gemini Imagen AI to generate images. Please note:

• AI-generated images may contain inaccuracies or artifacts
• The AI may refuse to generate certain types of content based on safety filters
• We do not guarantee the quality, accuracy, or appropriateness of generated images
• You are responsible for reviewing and verifying generated content before use

8. Disclaimers and Limitations of Liability

8.1 Service Availability

The App is provided "as is" and "as available." We do not guarantee that the App will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue the App at any time without notice.

8.2 Limitation of Liability

To the maximum extent permitted by law, Diotrix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or use
• Cost of substitute services
• Damages resulting from generated content
• Any damages arising from the use or inability to use the App

9. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.
